79. {Counts
77, 78, & 79 for 5th & 14th Amends. and Ky. Const.
§ 11} the
evidence clearly shows that police officer, GLENN BOGGS, denied Aarons
due-process during his first interrogation of this 15 year-old on the
day of the shooting. Not only did he coerce Aarons statements while
under extreme duress (the blood of his shot brother covered his clothes),
but also his interrogation was conducted without a guardian or adult present
while Officer Boggs knew the location of Aarons parents.
80. Subsequently, the Commonwealth introduced these statements into trial,
and James Shake, the presiding judge, allowed the statements to be admitted.
Here again, Aaron was denied a fair trial as his due-process was clearly
denied.
81. Officer Boggs violations have contributed to the wrongdoings
and harm as caused to Aaron and the Hardin family by the Commonwealth
and trial court. For three and one-half years, the family has sustained
insurmountable emotional and mental duress and distress from this unconstitutional
incarceration of Aaron. And since Aaron is still incarcerated, the acuteness
of their duress continues, today.
82. Therefore, the Hardin family demands due relief from the Court, which
includes Aarons release from incarceration.
Counts 80 through 82
Due-process Denied
83. The contents of above facts/paragraphs, 1 through 82, are hereby incorporated
by reference as though fully set forth. Here, Counts Eighty through Eighty-two
(82) concerns that at least the Louisville Police Department Violated
Aarons Due process Under the 5th and 14th Amendments, and Section
11 of the Ky. [Const.] Bill of Rights.
84. {Counts 80, 81, &
82 for 5th & 14th Amends. and Ky. Const. § 11}
the evidence clearly shows that police sergeant, RICK EASTHAM denied
Aarons due-process during his second police interrogation on the
day of the shooting. Not only did he coerce Aarons statements while
